OVERVIEW

This website and online store are operated by Fresh Royalty Everything LLC, doing business as Fresh Royalty Studios (“Fresh Royalty Studios,” “we,” “us,” or “our”). Fresh Royalty Studios offers this website, including all information, content, features, products, artwork, and services available through it, conditioned upon your acceptance of these Terms of Service.

These Terms of Service apply to all visitors, customers, purchasers, and other users of our website and services. They also apply when our products are discovered or purchased through an authorized third-party shopping channel, marketplace, social platform, or artificial-intelligence shopping service, including Shopify Agentic Storefronts.

By visiting our website, purchasing a product, or otherwise using our services, you agree to these Terms of Service and any policies referenced in them, including our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, you may not access or use our services.

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer and sell our products.

1. ELIGIBILITY AND ONLINE STORE TERMS

By using our services, you represent that you are at least the age of majority in your state, territory, province, or country of residence, or that you have permission from a parent or legal guardian to use our services.

You may not use our products, website, artwork, brand assets, or services for any unlawful or unauthorized purpose. You must not transmit viruses, malicious code, or any material designed to interfere with the operation or security of our website or services.

A violation of these Terms may result in the suspension or termination of your access to our services.

2. PRODUCTS AND SERVICES

Fresh Royalty Studios offers products that may include apparel, accessories, limited-edition merchandise, original artwork, art prints, collector pieces, collaborations, and other creative goods.

We make reasonable efforts to display product colors, textures, materials, dimensions, and other details accurately. However, colors and visual details may appear differently depending on your device, display settings, lighting, photography, or the handmade nature of a product.

Measurements are approximate unless expressly stated otherwise. Minor variations in placement, stitching, embroidery, printing, texture, brushwork, color, or finish may occur and are not necessarily defects.

Certain products may be produced, printed, embroidered, finished, or fulfilled after an order is placed. Production and processing estimates are not guaranteed delivery dates.

We reserve the right to:

• Limit the sale of products or services to any person, household, geographic region, or jurisdiction;
• Limit product quantities;
• Discontinue or modify products at any time;
• Correct descriptions, images, prices, or other information when an error is identified; and
• Refuse or cancel an order as permitted by law.

All product offers are void where prohibited.

3. LIMITED-EDITION AND ORIGINAL ARTWORK

Limited-edition products, signed prints, numbered pieces, original artwork, and collector items may have limited availability and may not be reproduced or restocked in the same form.

Unless a product listing expressly states otherwise, purchasing an original artwork, print, apparel design, or other product does not transfer any copyright, trademark, reproduction right, licensing right, commercial-use right, or other intellectual-property right to the purchaser.

Ownership of a physical artwork or product is separate from ownership of the intellectual property embodied in it. Customers may not reproduce, manufacture, distribute, tokenize, mint, license, sell copies of, commercially exploit, or create derivative works from Fresh Royalty Studios designs or artwork without our prior written authorization.

Any certificate of authenticity, edition number, signature, or provenance information supplied with a collector item should be preserved by the purchaser. Lost certificates may not be replaceable.

4. ORDERS AND ORDER ACCEPTANCE

Submitting an order does not guarantee its acceptance. An order is accepted when we confirm that it has been approved and entered into fulfillment, unless applicable law provides otherwise.

We reserve the right to refuse, limit, or cancel an order for legitimate reasons, including suspected fraud, unauthorized resale, pricing or inventory errors, payment problems, product unavailability, sanctions restrictions, or suspected violation of these Terms.

If we cancel an order after payment has been processed, we will issue a refund for the canceled portion to the original payment method.

You agree to provide current, complete, and accurate account, billing, shipping, and payment information. We are not responsible for delays, losses, or additional costs caused by inaccurate or incomplete information supplied by the customer.

5. PRICES, PAYMENTS, AND TAXES

Prices are displayed in the currency shown at checkout and may change without notice. A price change will not ordinarily affect an order that we have already accepted, except where correction is permitted by applicable law.

You authorize us and our payment processors to charge the payment method selected at checkout for the complete order total, including applicable shipping charges, taxes, duties, and fees displayed at checkout.

Customers are responsible for any customs duties, import taxes, brokerage charges, or other government fees not collected at checkout. These charges are determined by the destination country or jurisdiction and are outside our control.

We reserve the right to correct pricing, promotional, inventory, or product-information errors. If an error materially affects an order, we may contact you for instructions or cancel and refund the affected item.

6. DISCOUNTS AND PROMOTIONS

Discount codes and promotional offers are subject to their stated terms, expiration dates, product exclusions, and availability. Unless expressly stated otherwise, discounts cannot be combined, transferred, redeemed for cash, or applied retroactively to previous purchases.

We may modify, suspend, or cancel a promotion when reasonably necessary, subject to applicable law.

7. SHIPPING AND DELIVERY

Processing and delivery estimates are provided for informational purposes and are not guaranteed unless expressly stated.

Fresh Royalty Studios is not responsible for delays caused by carriers, customs processing, severe weather, natural disasters, labor disruptions, incorrect addresses, security checks, or other circumstances outside our reasonable control.

Risk of loss and legal title transfer according to applicable law and the shipping terms presented at checkout. Nothing in this section limits any non-waivable consumer rights.

8. RETURNS, REFUNDS, AND ORDER ISSUES

Returns, exchanges, cancellations, damaged items, incorrect items, lost shipments, and refund eligibility are governed by our separately published Return and Refund Policy, which is incorporated into these Terms by reference.

Customers should review that policy before placing an order. Nothing in these Terms or our Return and Refund Policy excludes rights that cannot legally be waived in the customer’s jurisdiction.

9. PURCHASES THROUGH AI AND THIRD-PARTY CHANNELS

Our products may be displayed or made available through authorized third-party services, including social platforms, search engines, marketplaces, AI assistants, and Shopify Agentic Storefronts.

Product recommendations, rankings, summaries, comparisons, or generated statements made by a third-party platform are controlled by that platform. Fresh Royalty Studios is responsible only for representations that we publish or expressly authorize.

The product description, price, availability, shipping information, policies, and order total presented through the authorized checkout process will govern the purchase, subject to applicable law.

Orders completed through a Shopify-powered checkout remain subject to these Terms and our applicable store policies. Your use of a third-party platform may also be governed by that platform’s separate terms and privacy practices.

10. INTELLECTUAL PROPERTY

The Fresh Royalty Studios name, brand identity, logos, graphics, artwork, photographs, videos, product designs, garment designs, collection names, written copy, slogans, website content, and other creative materials are owned by or licensed to Fresh Royalty Studios and are protected by applicable intellectual-property laws.

This includes, where applicable, the Fresh Royalty Studios wordmark, the crown and “R” monogram, “Hip Hop Luxury Movement,” “Movement Is Royalty,” “From the Underground to the Crown,” “Crowned in Motion,” and related visual and creative assets.

You may access our website for personal, noncommercial shopping purposes. You may not copy, reproduce, modify, distribute, publish, display, sell, license, scrape, train an artificial-intelligence system on, or commercially exploit our content without prior written permission, except where such restriction is prohibited by law.

No license or ownership interest is granted to you except the limited right to use our website for its intended purpose.

11. CUSTOMER CONTENT, REVIEWS, AND SUBMISSIONS

If you submit a product review, photograph, video, comment, testimonial, question, suggestion, or other content to us, you represent that:

• You own or have permission to submit the content;
• The content is truthful and does not violate another person’s rights;
• The content is not unlawful, abusive, fraudulent, defamatory, obscene, or misleading; and
• The content does not contain malicious software or unauthorized advertising.

Unless we separately agree otherwise in writing, you grant Fresh Royalty Studios a nonexclusive, worldwide, royalty-free license to display, reproduce, adapt, and share content that you intentionally submit for publication, marketing, review, or promotional purposes. This license does not transfer ownership of your content to us.

We may moderate or remove submitted content when reasonably necessary, but we are not obligated to monitor all submissions.

Creative concepts, artwork, designs, collaboration proposals, or other confidential materials should not be submitted unless we have agreed in writing to receive them. Unsolicited submissions will not create a confidential, fiduciary, or compensation obligation.

12. ACCOUNTS AND ACCOUNT SECURITY

If you create a customer account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

You agree to notify us promptly if you suspect unauthorized access. We may suspend or terminate an account when reasonably necessary to protect the customer, Fresh Royalty Studios, or other users.

13. PROHIBITED USES

You may not use our website, services, products, or content:

• For unlawful, fraudulent, deceptive, or abusive activity;
• To infringe intellectual-property, privacy, publicity, or other legal rights;
• To harass, threaten, discriminate against, or harm another person;
• To submit false information or impersonate another person;

The inclusion of a third-party link or tool does not necessarily constitute an endorsement.

15. ERRORS, INACCURACIES, AND OMISSIONS

Information on our website or connected sales channels may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, availability, pricing, promotions, shipping charges, transit times, or other details.

We may correct errors, update information, or cancel affected orders when permitted by law. We are not obligated to update information except as required by applicable law.

16. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, our website, services, and products are provided on an “as available” basis, except for warranties expressly stated in writing or required by law.

We do not guarantee that the website or services will always be uninterrupted, secure, error-free, or available. We do not warrant that every third-party recommendation, search result, AI-generated description, or external platform statement will be complete or accurate.

Products remain subject to any express warranties and non-waivable consumer protections provided by applicable law. This section does not exclude warranties or rights that cannot legally be excluded.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Fresh Royalty Studios and its owners, officers, employees, contractors, representatives, licensors, service providers, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of—or inability to use—our website, services, or products.

Where liability cannot be completely excluded, our liability will be limited to the maximum extent permitted by law.

Nothing in these Terms limits liability for fraud, willful misconduct, gross negligence, personal injury caused by negligence, or any other liability that cannot lawfully be limited or excluded.

Personal information submitted through Shopify or an authorized third-party channel may also be processed by Shopify, payment providers, fulfillment providers, carriers, AI shopping services, or other providers necessary to facilitate discovery, checkout, payment, fraud prevention, fulfillment, analytics, or customer support.

20. TERMINATION

These Terms remain effective unless terminated by you or us.

You may stop using our website and services at any time. We may suspend or terminate access if we reasonably believe you have violated these Terms, created legal or security risk, engaged in fraud, or misused our services.

Obligations and liabilities incurred before termination, along with provisions that by their nature should survive termination, will remain effective.

21. SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will continue in effect.

22. NO WAIVER

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any additional terms presented at checkout, constitute the agreement between you and Fresh Royalty Studios concerning your use of our store and services.

If specific terms for a product or promotion conflict with these general Terms, the more specific terms will control to the extent of the conflict.

These Terms are governed by the laws of the State of Hawaii and applicable federal laws of the United States, without regard to conflict-of-law principles.

Nothing in this section prevents a consumer from relying on mandatory protections or bringing a claim in a forum available under the laws of the consumer’s jurisdiction.

We may update these Terms from time to time to reflect changes to our products, business practices, technology, sales channels, or legal obligations.

The current version will be posted on this page with an updated revision date. Changes apply prospectively from the date they are published unless otherwise required by law.
